Terms of Service
This Terms of Service Agreement ("Agreement") is a legal agreement between you, the user ("User," "you," or "your"), and MyInternetBroker ("Company," "we," "us," or "our") for the provision and use of our internet services (the "Services"). By accessing or using the Services, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms, you may not use the Services.
1. Service Description
We agree to provide you with internet access and related services as described in your selected service plan. The speed, reliability, and availability of the Services may vary depending on network conditions, location, and other factors. We do not guarantee uninterrupted or error-free service.
2. Billing and Payment
2.1. Fees and Charges. You agree to pay all fees and charges associated with your use of the Services, including but not limited to monthly service fees, equipment rental fees, taxes, and any applicable one-time charges. All prices are in [Canadian/US Dollars].
2.2. Invoicing and Payment. You will be billed on a monthly basis. All invoices are due and payable within 30 days of the invoice date. Late payments may result in suspension or termination of your Services and a late fee.
2.3. Price Changes. We reserve the right to change our fees and charges at any time. We will provide you with at least 30 days' notice of any change that affects your monthly recurring charges.
3. Acceptable Use Policy (AUP)
You agree to use the Services in a lawful and responsible manner. You will not use the Services to:
Engage in any illegal or fraudulent activity.
Transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or obscene.
Infringe upon the intellectual property rights of others, including copyright and trademark.
Send unsolicited commercial email ("spam").
Interfere with or disrupt the Services or networks connected to the Services.
Attempt to gain unauthorized access to any system, network, or data.
We reserve the right to suspend or terminate your Services without notice if you violate this AUP.
4. Limitation of Liability and Disclaimer of Warranties
The Services are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We will not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Services or any failure of the Services. This limitation of liability applies even if we have been advised of the possibility of such damages.
5. Termination
5.1. Termination by You. You may terminate this Agreement at any time by providing us with at least 30 days' written notice. You may be responsible for early termination fees if you are in a fixed-term contract.
5.2. Termination by Us. We may terminate or suspend your Services and this Agreement at any time, for any reason, including but not limited to a breach of this Agreement, non-payment of fees, or for security reasons.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Ontario/Alberta/British Columbia or the United States], depending on your location, without regard to its conflict of law principles. Any legal action or proceeding arising from this Agreement shall be brought exclusively in a court of competent jurisdiction in the appropriate province or state.
7. General
7.1. Entire Agreement. This Agreement constitutes the entire agreement between you and the Company with respect to the Services.
7.2. Changes to this Agreement. We may modify this Agreement at any time. Your continued use of the Services after such modifications constitutes your acceptance of the new terms.
